The July 2026 update
Immigration New Zealand announced changes to the Business Investor Work Visa on 6 July 2026. Eligible franchise businesses can now be considered, applicants can purchase through a New Zealand resident entity, and gifted investment capital can be accepted where it was lawfully earned. The announcement says the existing business requirements still matter. These changes broaden the ways an investment may be structured; they do not make every franchise, company purchase or family gift qualifying. Prospective applicants should therefore revisit previously excluded opportunities while keeping commercial due diligence and immigration eligibility as separate tests that both need to be satisfied.
Why a franchise requires its own review
A recognised brand can make a proposed business easier to understand, but brand familiarity is not a substitute for examining the individual operation. Request the franchise agreement, the business's financial records, information about the premises and the obligations owed to the franchisor. Distinguish revenue from profit and identify payments that continue even during a difficult trading period. The immigration announcement opens a category of opportunity; it does not certify the commercial performance of a particular outlet. A buyer should also examine whether the proposed ownership and management role fits both the franchise contract and the current visa instructions. Conflicts between those documents are easier to resolve before signing a binding purchase agreement.
Buying through an entity changes the evidence trail
The ability to purchase through a New Zealand resident entity may fit ordinary business practice, but the ownership structure must still be understandable. Draw a simple diagram showing the applicant, the purchasing entity and the target business. Identify who contributes the capital, who owns the shares and who controls decisions. Give that diagram to the professionals advising on the transaction so that immigration, corporate and tax questions are considered together. An extra company in the structure should have a clear commercial purpose. Avoid assuming that incorporation alone resolves every requirement; the current definition and conditions governing the eligible resident entity must be checked in the visa instructions.
Document a gift from its origin to its destination
A gift can require more explanation than savings accumulated directly by the applicant. Build a chronological record showing the donor, the relationship, how the donor acquired the funds, the gift arrangement and the transfers through the banking system. Ask what evidence the current instructions require rather than inventing a document package based on hearsay. For planning purposes, distinguish an unconditional gift from a loan that must be repaid, and disclose the true arrangement. A signed statement is easier to assess when it agrees with bank records and other evidence. Moving money through several accounts without preserving statements can make a lawful transaction unnecessarily difficult to explain.
Keep immigration milestones out of sales promises
A seller or broker may be enthusiastic about the visa implications of a transaction, but their commercial interest is different from the government's role in assessing an application. Ask for written clarification of any claim that a business is eligible and verify it against official requirements with an appropriately qualified adviser. The sale contract should be reviewed for what happens if an immigration decision is delayed or the proposed investment does not satisfy the route. Do not rely on a verbal assurance that all money will be returned. The parties should understand conditions, deadlines, deposits and the consequences of failure before funds become committed.
Assess the business as an operating enterprise
The visa route concerns business investment, so prepare to understand the operation beyond its purchase price. Review customers, suppliers, staffing, leases, licences, working capital and the owner's role. A profitable business can still have cash-flow pressure if customers pay late or equipment needs replacement. Make a conservative operating forecast that separates the acquisition cost from money required after completion. This is original planning guidance rather than a claim that INZ requires a particular spreadsheet. Its purpose is to help an applicant recognise whether the proposed business is manageable and whether the immigration plan depends on assumptions that the commercial records do not support.
Compare this route with other investment choices carefully
Someone seeking a hands-on business role may have different objectives from someone seeking a largely portfolio-based investment. New Zealand's Business Investor Work Visa and Active Investor Plus route should be examined on their own current terms rather than grouped under a generic golden-visa label. Compare the expected involvement, permitted investments, subsequent milestones, family arrangements and evidence burden. The cheapest apparent entry cost is not necessarily the best fit for the applicant's experience or plans. If the person does not want to run or oversee a business, that preference should be made explicit before an adviser or broker begins recommending acquisitions.
Questions to resolve before proceeding
Use the official July announcement to identify what changed, then read the current Business Investor Work Visa page for the complete requirements. Ask whether the target business qualifies, whether the proposed ownership arrangement is acceptable, how the investment funds will be evidenced and what must happen after approval. Keep a written list of assumptions with the person responsible for checking each one. A hypothetical buyer considering a franchise funded partly by a parental gift now has more options to investigate, but still needs a sound business, a transparent funding history and a compliant immigration application. The change creates possibilities; careful verification determines which possibilities are usable in an individual case.
